Section: GSTR-5A is governed by the Section 39(9) of the Central Goods and Services Tax Act, 2017.
Purpose: GSTR-5A is a return form that needs to be filed by Non-Resident Taxable Person (NRTP) who extends their business in India and needs to obtain GST registration. This return form is used to provide the details of the inward supplies made by the NRTP during the previous month.
Applicability: GSTR-5A applies to all Non-Resident Taxable Persons who have obtained a GST registration and are making supplies in India.
Timeline: GSTR-5A is filed on a monthly basis. It needs to be filed within 20 days from the end of the previous tax period. For example, for the tax period of March, the due date for filing GSTR-5A would be 20th of April.

Exemption: There are no exemptions for filing GSTR-5A. NRTPs are required to file this return form every month.
Penalty: If a NRTP fails to file GSTR-5A within the due date, then he/she will be liable to pay a late fee of Rs. 200 per day (Rs. 100 under the Central Goods and Services Tax Act and Rs. 100 under the State Goods and Services Tax Act) until the return is filed. The maximum amount of late fee that can be charged is Rs. 5,000.
Due Date: The due date for filing GSTR-5A is within 20 days from the end of the previous tax period.
Forms: GSTR-5A is an online form that can be filed on the GST portal.
Reporting Authority: GSTR-5A needs to be filed with the Goods and Services Tax Network (GSTN), which is the IT backbone of GST in India.
